These Terms of Use ("Terms") govern your access to and use of Pinkerton AI (the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and legally able to enter into these Terms. The Service is intended for adults.
2. The Service
Pinkerton AI provides access to AI models that may produce uncensored or unfiltered output, along with related tools (chat, file/PDF tools, image generation, web search). AI output may be inaccurate, incomplete, offensive, or unsuitable for a given purpose. You must independently verify any information before relying on it.
3. Acceptable use & your responsibility
You are solely responsible for how you use the Service and any output you obtain. You agree not to use the Service to:
- break any applicable law or regulation, or infringe the rights of others;
- create or distribute content involving the sexual exploitation or abuse of minors (CSAM), or content that sexualizes minors;
- plan, facilitate, or carry out violence, terrorism, trafficking, or other serious harm to people;
- develop or deploy malware, conduct fraud, or attack the security or integrity of any system;
- harass, threaten, dox, or impersonate others;
- abuse, overload, scrape, reverse engineer, or circumvent limits or security of the Service.
You are responsible for ensuring your use complies with the laws that apply to you. We may suspend or terminate access that we reasonably believe violates these Terms or the law.
4. Anonymous sessions & recovery codes
The Service is used through anonymous sessions. Any recovery code provided to you is the only way to restore access to a session and its balance; if you lose it, we may be unable to recover your session. Keep it safe. You are responsible for activity carried out through your session.
5. Plans, credits & payments
- Paid plans and credits are described at checkout. Prices are shown in the currency indicated and may include applicable taxes.
- Card payments are processed by Stripe. By subscribing you authorize recurring charges for the chosen plan until you cancel.
- Subscriptions renew automatically for successive periods unless cancelled before the renewal date. You can cancel at any time; access continues until the end of the paid period.
- Cryptocurrency payments are final once confirmed on-chain and are generally non-refundable.
6. Refunds
Except where required by mandatory law, fees for digital services already delivered (for example, credits that have been consumed) are non-refundable. Any statutory withdrawal rights you may have are not affected by this section.
7. Intellectual property
The Service, its software, branding, and content (excluding your inputs and AI output) are owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms. Subject to applicable law and third-party model terms, you may use the output you generate; you are responsible for it.
8. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
9. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages, or for loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the three (3) months before the event giving rise to the claim.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or where required to protect the Service, other users, or comply with law.
11. Governing law
These Terms are governed by the laws of France, without prejudice to mandatory consumer protections of your country of residence.
12. Changes
We may update these Terms. Continued use after changes take effect constitutes acceptance. The date at the top reflects the latest version.
